What could I charge people for at a homemade Drive-In Movie Night?
I want to start a local movie night for the public and screen various movies to either a crowd sitting outside or drive-in style with a high end projector. Due to copyright issues what am I allowed to charge people for? Can't charge admission for the movie I don't think. Couldn't I just say I'm charging for parking and the movie is free? What legal consequences do I need to dodge?
You cannot charge anything. And if you benefit indirectly like from parking, that is illegal too. And if you get the movies from normal consumer sources and even show them to groups of people you don't know that is illegal.
If you look at the fine print on the DVD or tape, there are words printed on it to the effect of "Not licensed for public exhibition". This means that while you can watch it, even with others in the privacy of your own home, showing it anywhere the general public can come into is illegal. You can even be taken to court for showing a DVD you purchased in a place where the public shows like a bar.
Even showing a movie in class to a bunch of students a school is illegal unless clearance is obtained and a fee is paid.
Even playing a radio that is playing copyrighted music in a bar is illegal. When you hear music or see movies played in public places, those people are paying extra license fees to be allowed to do it.
Even when you see music videos being played in the Gap, those are special commercially licensed ones.
While there is no movie gestapo going around to find people doing what you say, eventually one of your patrons will be the kid of a cop or something and eventually, you will be busted. You may or may not see any jail time but you will become really familiar with a lawyer. And there is no public defender for something like this. Be prepared to spend a ton of money on legal fees if you do this.
As for getting licensing, exhibition of movies to the public is pretty well limited to the chains, like theaters who pay tons of money to the media owners. They don't want to talk to you unless you are going to generate $100,000 or more in license revenue for them.
